TERMS & CONDITIONS OF SALE
1 All prices are F.O.B. shipping point and are subject to change without notice.
2 All materials are shipped at customers’ own risk. In case of damage claims must be filed with carrier.
3 No claims for damage or shortage considered unless made within 24 hours of receipt of material.
4 Authorized returns will be subject to a 20% handling charge. They must be returned within 30 days and be accompanied by the original sales slip.
5 Special orders or hold orders require 50% Deposit and are non-cancelable. No returns accepted on special order materials. Stocked materials subject to our inspection, can be returned, full cartons only, and if accepted, requires a handling charge within 30 days. No credit will be allowed on special order merchandise.
6 Under no circumstances will Roma Tile Co. Inc., or the manufacturer be responsible for the wearing excessively or breakage occurring before, during or after installation.
7 No tile is guaranteed against crazing, wear or scratching.
8 All material is sold subject to variation in shade and must be inspected prior to installation by purchaser. On completion of installation, the care and protection of materials installed shall be risk of purchaser. Absolutely no allowance can be made or claims considered after tile has been installed as use constitutes acceptance.
9 Our responsibility will not exceed the selling price of the material.
10 All off grade and closeout goods sold as is. Sale items, discontinued items and end lots are non-returnable.
11 Terms are Net 30 Days - 1 1/2 % service Charge per month on Past Due Invoices, Annual Rate of 18%.
12 Purchaser agrees to pay all costs of collection, including reasonable attorney’s fee, all disbursements and Court cost.
